Data protection: clearer rules for cross-border enforcement

The European Parliament has announced an agreement with the Council of the EU to improve the enforcement of the General Data Protection Regulation (GDPR) in cross-border cases. This new regulation aims to enhance cooperation between national data protection authorities and make enforcement more efficient and transparent for citizens and organizations.

 

Key features of the agreement include:

  • Harmonized admissibility criteria for complaints across all EU member states.
  • Clear procedural rights for both complainants and organizations under investigation, including the right to be heard and access to preliminary findings.
  • Binding deadlines for investigations: 15 months for complex cases (with a possible 12-month extension) and 12 months for simpler cooperation procedures.
  • Early resolution mechanisms to expedite straightforward cases.
  • Simplified cooperation procedures to reduce administrative burdens.

This regulation addresses long-standing challenges in GDPR enforcement, such as delays and inconsistent procedures, and marks a significant step toward ensuring citizens' data protection rights are upheld more effectively across the EU.
